Violations are felonies, and carry criminal penalties.
However, these laws are NEVER enforced.

Call your nearest US Attorney office, and ask for the public information officer.
Ask them, point plank: "Has your office ever prosecuted a Copyright case?"
The answer will be "No" ... "All complaints must proceed through the Civil system."

I'm a little confused by your post.
As best I understand it the Big Business folks ( Google, Facebook, GM, Monsanto.....all of them.... ) use the civil courts to tamp down anything that even looks like a infringement. The effect of that is to both stop the actual and to stifle the not necessarily so from preceding with something that might be competitive.
We need to change the copyright laws & patent laws so as to allow more competition. Might even have a impact on "income inequality".....if you really think through the economic implications.
