I’m not following you at all. What “same punishment” is the law calling for?

Trump is facing a max of 20 years and so is Hunter. Neither one has any previous convictions.

In Hunter's case previous convictions have gotten 3 to 6 months in jail for lying on the form. I could not find anything for penalties on a known user simply possessing a gun.

My guess would be Hunter is looking at a fine, maybe 6 months max and probation.

Trump's case the average penalty is less than a year, fine, and probation. My guess is Trump also gets a fine and probation and no jail time.

So both are similar in penalties, what do you think the sentencing should be?

Probation as to both, with Trump being given special permission to travel out-of-state to campaign. 

That's not the same thing as the law "calling for" the same punishments as to both. Phrasing the comparison in those terms actually has legal meaning that wouldn't likely be correct. 

Hunter will be guilty on the two felony charges involving filling out the form. He may be found not guilty on the possession charge as I am not sure possession can be proven if he was not caught with the gun in his possession. I know he had to possess it, but not sure how the law works on knowing he had to possess and actually having proof he had possession for that charge. 

If Hunter is found not guilty, there will be no appeal. Hung jury will just restart the process. Prosecution cannot appeal a not guilty verdict. Double jeopardy clause prevents it. The defense can appeal any guilty verdict. 

Wake up! Smell the coffee grounds and burnt toast!

The chances of a successful appeal are minuscule.

The real measure, however, won't be obvious.

It's the "dollars versus days ratio" that matters most.

How many dollars in legal fees, divided by the number of days it takes.

That presupposes that the former president is granted appeal bond.

( which is not automatic )

What is much more likely is an immediate trip to Rikers.

( Do not pass Go, do not collect $200 )

Think, for just a moment, where Mr. Trumps mental "issues" have taken him.

His current predicament is entirely of his own making, above and beyond the crimes.

Trump is completely obsessed with the perception of being entirely without fault. 


Instead, he screwed himself in the butt with a cactus: "no misdemeanors".

He refused to allow his attorneys to place that possibility into the jury instructions!

He refused to admit anything wrong at all ... so it was either a felony, or acquittal.

A "martyr complex" serves as the cherry on top of his toxic narcissism.

He wants to be sentenced to jail ... it's sick, but he subconsciously wants to be punished.

But of course, he expects ... "Deus Ex Machina"! The Supreme Court will save him!

Then he'll be reelected to a new term as America's first proto-Kaiser.

( sunshine through clouds - cue the trumpets )


In fact, reality will probably slap him silly.

It's entirely possible that Trump will take an immediate trip to Rikers Island for at least 90 days.

That's just for current contempt of court charges. ( between now and then, they could get worse ).

If Trump get's six-months, that's cool ... he'll be out just in time to be inaugurated.

The judge might not impose sentence for the conviction until after the contempt sentence is served.

Or, he could run the two together ... there are many options.

In either case, there will be no bond on the contempt charges and no appeal is available.

The Republican convention should be a real hoot!
